The agreement
These terms cover your use of Counter Club, the loyalty card and campaigns tool operated by the Not a Chain team, trading under an Australian sole-trader ABN, provided on request. Opening a Counter Club account is your agreement to them.
The service
Counter Club provides a stamp card that customers join with a mobile number confirmed by a texted code, a Members page from which the shop records stamps and sees reward codes, and, on paid plans, campaigns by email and, on the top plan, by text from a number provided for the shop. Everything the service does is described on this site; nothing beyond that is promised.
Plans and payment
Three plans are offered: Free, Regulars at $24 a month, and Local Favourite at $69 a month, in Australian dollars. GST is not charged because the operator is not registered for it. Paid plans are billed monthly in advance by card through Stripe and may be cancelled at any time from Billing; cancellation stops the next charge and the plan runs to the end of the paid period. Prices may change with at least thirty days notice by email to your confirmed address.
The Free plan is provided in return for the marketing consent given at sign-up, described on the consent page. Withdrawing that consent while on Free means the free plan runs to the end of the current month, Melbourne time, and then ends unless a paid plan is chosen or the consent is given again from the Account page.
Quotas for each plan (members, campaign messages a month) are shown on the pricing page and in the dashboard. A monthly quota resets on the first of each calendar month, Melbourne time.
Your responsibilities
You are responsible for the content of every campaign you send, for honouring the rewards you set, for complying with the Spam Act 2003 and any rules that apply to your trade, including liquor promotion rules, and for keeping your sign-in details secure. You must not use Counter Club to message anyone who did not join your club, and the service gives you no means to do so.
Members
Members of your club are your customers. We hold their details to run the service for you and for no other purpose. You must honour a member's request to be removed and must not attempt to contact an opted-out member through the service.
Suspension and ending
We may suspend an account that breaches these terms or the acceptable use policy, after telling you why, unless the breach is serious. You may end your account at any time by cancelling and emailing hello@notachain.com.au. When an account ends, its data is deleted as described on the privacy page.
The directory
Counter Club is separate from the Not a Chain directory. Nothing in these terms, and nothing you pay, affects any listing, ranking or badge on the directory.
Liability
We provide the service with reasonable care and skill. To the extent the law allows, we are not liable for indirect or consequential loss, and our liability for any claim is limited to the fees you paid in the three months before the claim. Nothing in these terms limits any right you have under the Australian Consumer Law.
Law
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
